Importance of language in law
Law is a professional course which is sovereign
itself. Although in every field or any subject we need a language to represent
its theory. Now if we talk about the legal language. It’s nothing but the
language which an advocate or a judge uses in drafting for the purpose of
litigation.
Legal language provides the base for law people and also for the layman. It just gives the structure to the body called law. Law is a subject
which cannot be studied without a particular language because it’s a codified
subject and practiced by various countries, so it needs a particular language
for all. A common basic language and its there as a legal subject called “Legal
English”.
Law has a technical language itself and its necessary
for all the legal aspirants to learn important legal terms for practicing it
professionally. Law’s language is not originated with any other language; it’s
the part of English. Legal English is all which is discover from the main
language called English, which is used by many countries in the world at large,
which is either a first language or second, it’s the most popular language in
the world.
Legal English is a different language because it contains English in
codified form which can be used at any legal platform in all over world it
gives the individuality to the subject. Law mere is not about the legal English
it’s a subject which includes codification of acts and drafting skills and for
that it is necessary to have a language which can easily define the term law.
Law is just not a subject but it’s a legal body of rules and norms which is
valid on the basis of language. Legal language is a special language which does
not focus on grammatical of the sentence but it focuses on its meaning by
which a rule is set for the void things happening around us and make it a law. Law is also known for its verbal nature, it’s a subject which is practiced not
only in a written form but also in oral form too that’s why a strong language
is important to interpret the law verbally in a representative manner. Language
of law contains the special vocabularies of law terms only and that’s what
makes it different from other languages. Law is totally depends on its language
and it’s not easy to learn the law without its specialized language.
Legal
practitioner mostly prefers the legal vocabulary and legal maxim which is Latin
terminology to concise the meaning. All the legal cases turn on the meaning that
judges ascribe to words, and lawyers must use the right words to effectuate the
wishes of their clients. Legal language describe the words in totally different
context like if we a take an example of word “consideration” and its actual
meaning is thoughtful but in law its nothing to do with thoughtfulness but it’s
used as “ value of given party to an agreement .”
So legal language is totally dynamic and it’s not a
normal English but it has its own individuality with comparison to any other
language .Vocabulary of law contains the words which have totally different
meaning in layman's language. There are words that have come to signify large
bodies of law or legal doctrine act as shorthand terms for complex concepts.
